Abstract

This study is a fundamental brief examination of linguistic appraise meaning، and the dispute among scholars regarding its ability to prove legal provisions. The work declares that the dispute is limited to one area of linguistic appraise. Such differences were caused mainly by linguistic differences. The work also indicated that the say that linguistic appraise was used by Imam Al-Shafii to prove legal provision was not true. The questions used in such specific claims were actually judged and answered using text evidence not linguistic appraise. The impact of the differences in utilizing linguistic appraise for jurisprudence is more than that when used for doctrinal provisions. Most of the doctrinal provisional differences is tracked back to differences in provision evidences rather than linguistic appraise itself. Key Words: Legal provisions، Linguistic appraise.
