Abstract

This paper deals with a type of analogy criteria called the analogy of similarity. As defined by canonists it is a description whose relatedness (purposes) is inconceivable when it is considered alone. Its relatedness is only assumed when the legislator refers to it in some statutory laws. It is therefore placed at the bottom of the scale of analogy. It is given the name similarity because it is similar to the one that is related, on the one hand, and to the unrelated one on the other. On the basis of its similarity to the former, it is supposed to be considered, and on the basis of its similarity to lather, it is supposed to be disregarded
